TITLE OF BILL:
An act to amend the social services law, in relation to when services
for traumatic brain injuries granted pursuant to a waiver by the federal
social security act shall begin
PURPOSE:
This is a chapter amendment that makes changes to L.2024, c.649, to
clarify provisions related to carving out services to Medicaid recipi-
ents suffering from traumatic brain injuries (TBI) or qualifying for
nursing home transition and diversion (NHTD)services from Medicaid
Managed Care (MMC).
SUMMARY OF PROVISIONS:
This bill amends the underlying chapter to permanently carve the TBI
waiver out of MMC and extend the carveout of the NHTD waiver through
April 1, 2027.
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.
LEGISLATIVE HISTORY:
Chapter amendment to Chapter 649 of the Laws of 2024. S.2867 and A.7369
both passed the Senate and Assembly during the 2024 Legislative Session.
FISCAL IMPLICATIONS:
None
EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2024 amending the Social Services Law relating to
the provision of services to certain persons suffering from traumatic
brain injuries or qualifying for nursing home diversion and transition
services, as proposed in legislative bills numbers S.2867 and A.7369,
takes effect.
