TITLE OF BILL:
An act to amend the energy law, in relation to requiring new buildings
where new parking is provided to have electric vehicle charging infras-
tructure; and to repeal certain provisions of the executive law relating
to certain standards in the New York state uniform fire prevention and
building code
PURPOSE:
This chapter amendment requires the State Fire Prevention and Building
Code Council to promulgate standards that would require new buildings
with new parking to have electric vehicle charging infrastructure and
charging stations.
SUMMARY OF SPECIFIC PROVISIONS:
Section one repeals the underlying chapter in the executive law creating
statutory requirements for electric vehicle charging infrastructure and
charging stations in new construction buildings where parking is
provided.
Section two amends the energy law to require the Uniform Fire Prevention
and Building Code Council to update the Energy Code in the next code
development cycle after December 2026 to include standards and provide
exemptions for the inclusion of electric vehicle charging infrastructure
and charging stations in new construction buildings where new parking is
created.
Section three includes the effective date.
JUSTIFICATION:
The presence of electric vehicle (EV) charging stations and parking
spaces in a community is associated with greater use of EVs. However,
the rate of adoption of EV parking spaces has been slow, mirrored by the
slow adoption of EVs themselves. In 2021, New York' State took steps to
address to slow adoption of EVs by mandating new vehicles in the state
be all-electric by 2035. For the adoption of this policy to be success-
ful, the installation of the hardware needed to support a large number
of EVs on the road should be a priority of the state. Accordingly, this
bill seeks to align New York's construction and building code policy
with the goals of the state expressed in the Climate Leadership and
Community Protection Act as well as the 2021 EV sales mandate by mandat-
ing the installation of EV infrastructure in certain instances during
new construction.
This bill amends L.2024 c.643 to specify that the Uniform Fire
Prevention and Building Code Council must promulgate electric vehicle
infrastructure and charging standards for new parking in new buildings
during the next Energy Code development cycle. This bill is a negoti-
ated change to the underlying chapter.
LEGISLATIVE HISTORY:
This bill amends Chapter 643 of the Laws of 2024. S.1736-E and A.3780-E
passed the Senate and Assembly in June 2024.
FISCAL IMPLICATIONS:
To be determined.
EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2024 amending the executive law relating to
requiring new construction that includes dedicated off-street parking to
provide electric vehicle charging stations and electric vehicle ready
parking spaces, as proposed in legislative bills numbers S.1736-E and
A.3780-E, take effect.
