TITLE OF BILL:
An act to amend the family court act, in relation to findings in child
abuse or neglect proceedings in family court
 
PURPOSE:
This is a chapter amendment that makes changes to provisions of L.2024,
c.621, to clarify provisions relating to notices given to respondents in
child abuse and neglect proceedings in Family Court.
 
SUMMARY OF PROVISIONS:
This legislation amends the underlying chapter by modifying language to
simplify the notice provided to respondents by Family Court judges in
Article 10 neglect or abuse proceedings related to the impact on reports
of maltreatment or abuse maintained by the State Central Register. The
legislation also gives Family Court judges the ability to provide such
notice in substantially similar terms to the statutory language.
 
EXISTING LAW:
None.
 
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.
 
LEGISLATIVE HISTORY:
Chapter amendment to Chapter 621 of the Laws of 2024. S.9745 and A.7348
both passed the Senate and Assembly, respectfully, in June 2024.
 
FISCAL IMPLICATIONS:
None.
 
EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2024 amending the family court act relating to
notices given to respondents in child abuse and neglect proceedings in
family court, as proposed in legislative bills numbers S.9745 and
A.7348, takes effect.
