TITLE OF BILL:
An act to amend the workers' compensation law, in relation to claims for
mental injury premised upon extraordinary work-related stress; and to
amend a chapter of the laws of 2024 amending the workers' compensation
law relating to claims for mental injury premised upon extraordinary
work-related stress, as proposed in legislative bills numbers S. 6635
and A. 5745, in relation to the effectiveness thereof
 
PURPOSE OF BILL:
This is a chapter amendment that makes changes to provisions of L.2024,
c.546.
 
SUMMARY OF SPECIFIC PROVISIONS:
This legislation amends the underlying chapter by specifying the quali-
fying categories of mental injury caused by extreme stress for non-emer-
gency workers and clarifying the proper diagnostic criteria to be used
by the Workers' Compensation Board.
 
JUSTIFICATION:
Pursuant to approval memo 21 of 2024, the Executive expressed support
for the goal of the legislation, but noted that changes were required to
specify the categories of mental injury eligible for compensation. This
legislation is a negotiated change to the underlying chapter that
addresses those concerns.

EFFECTIVE DATE:
This act shall take effect immediately; provided, however, that section
one of this act shall take effect on the same date and in the same
manner as a chapter of the laws of 2024 amending the workers' compen-
sation law relating to claims for mental injury premised upon extraor-
dinary work-related stress, as proposed in legislative bills numbers
S.6635 and A.5745, takes effect.
