TITLE OF BILL:
An act to amend the public authorities law, in relation to requiring
electric vehicle charging stations to include at least one space to
accommodate wheelchair accessible electric vehicles
 
PURPOSE:
This is a chapter amendment that makes changes to provisions of L.2024,
c.618, requires electric vehicle charging stations and electric vehicle
capable parking spaces to accommodate wheelchair accessible electric
vehicles
 
SUMMARY OF PROVISIONS:
This legislation makes technical changes to certain electric vehicle
wheelchair access requirements for the underlying chapter.
 
JUSTIFICATION:
Electronic vehicles (EV'S) are becoming increasingly popular as New
Yorkers begin to conform to New York's climate goals and mandates; EV
charging stations should be accessible to all our state's citizens.
That is not the case for those individuals with disabilities and their
need for larger charging spaces depending on the type of vehicle. Just
as there are designated spaces for ADA accessible parking for gas driven
vehicles there should also be safe, easy access to EV charging stations
for wheelchair accessible vehicles. The spaces should be labeled as ADA
accessible EV charging stations and be large enough to accommodate the,
vehicles used by New Yorkers with disabilities.
This legislation is a negotiated change to the underlying chapter.
 
LEGISLATIVE HISTORY:
Chapter Amendment to Chapter 618 of the Laws of 2024. 5.8979 and A.7091
both passed the Senate and Assembly in June 2024.
 
FISCAL IMPLICATIONS:
This bill will have no direct costs to the State and none to local
governments. NYPA, which is funded off-budget, would be responsible for
the costs of expanding electric vehicle charging stations and electric
vehicle-capable parking spaces available for wheelchair-accessible elec-
tric vehicles.
 
EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2024 amending the public authorities law relating
to requiring electric vehicle charging stations and electric vehicle
capable parking spaces to accommodate wheelchair accessible electric
vehicles, as proposed in legislative bills numbers S. 8979 and A. 7091,
takes effect.
