TITLE OF BILL:
An act to amend the public health law, in relation to medically fragile
young adults; to amend a chapter of the laws of 2024 amending the public
health law relating to medically fragile young adults and pediatric
specialized nursing facilities, as proposed in legislative bills numbers
S. 5969-A and A. 3674-A, in relation to the effectiveness thereof
 
PURPOSE:
This is a chapter amendment that makes changes to L.2024, c.597, which
requires the Department of Health (DOH) to allow medically fragile young
adults who reside in pediatric specialized nursing facilities to remain
in those facilities until the age of 36. These pediatric specialized
nursing facilities would receive the enhanced rate for treating
medically fragile children, including a daily per diem rate and coverage
for bed holds unless DOH sets a higher rate.
 
SUMMARY OF PROVISIONS:
This bill amends the underlying chapter by conforming changes to the
definition of medically fragile young adult to align it with existing
statute and ensure that the provisions are subject to federal financial
participation. The chapter amendment also extends the effective date to
nine months after it is signed into law.
 
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.
 
LEGISLATIVE HISTORY:
Chapter amendment to Chapter 597 of the Laws of 2024. S.5969-A and
A.3674-A both passed the Senate and Assembly during the 2024 Legislative
Session.
 
FISCAL IMPLICATIONS:

EFFECTIVE DATE:
This act shall take effect immediately; provided however, that section
one of this act shall take effect on the same date and in the same
manner as a chapter of the laws of 2024 amending the Public Health Law
relating to medically fragile young adults and pediatric specialized
nursing facilities, as proposed in legislative bills numbers S.5969-A
and.A.3674-A, takes effect.
