TITLE OF BILL:
An act to amend the social services law, in relation to requiring elec-
tronic benefit transfer systems to provide for benefit recipients to be
able to cancel, lock or unlock a card associated with electronic benefit
transfer services; and to amend a chapter of the laws of 2024 amending
the social services law relating to requiring electronic benefit trans-
fer systems to provide for benefit recipients to be able to cancel, lock
or unlock a credit or debit card associated with electronic benefit
transfer services, as proposed in legislative bills numbers S.8662-A and
A.9269-B, in relation to the effectiveness thereof
 
PURPOSE:
This chapter amendment clarifies provisions of L.2024,c.487 regarding
electronic benefit transfer systems.
 
SUMMARY OF PROVISIONS:
This amendment modifies the underlying chapter to address electronic
benefit transfer (EBT) systems, specifically requiring these systems to
enable benefit recipients to cancel, lock, or unlock their EBT cards.
Subsection 1(c) makes the following changes to the underlying chapter:
1) It removes the option for EBT benefit recipients to report fraud
through any interactive voice response (IVR) system associated with
electronic benefit transfer services; 2) It stipulates that any IVR
system for electronic benefit transfers must allow recipients to perma-
nently cancel, lock, and unlock their EBT cards; 3) It eliminates refer-
ences to EBT cards as credit or debit cards, clarifying that EBT cards
are neither; and 4) It removes the provision that allowed recipients to
lock their cards for out-of-state or online purchases only through an
IVR system connected to the electronic benefit transfer system.
Additionally, Section 2 of the underlying chapter changes the effective
date from six months to one year after the law is enacted.

JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.

Chapter amendment to Chapter 487 of the Laws of 2024. S.8662-A passed
the Senate in June 2024 and A.9269-B passed the Assembly in April 2024.
 
FISCAL IMPLICATIONS:
None.
 
EFFECTIVE DATE:
This act shall take effect immediately; provided, however, that section
one of this act shall take effect on the same date and in the same
manner as a chapter of the laws of 2024 amending the Social Services Law
to require electronic benefit transfer systems to allow benefit recipi-
ents to cancel, lock, or unlock a card associated with electronic bene-
fit transfer services, as proposed in legislative bills S. 8662-A and A.
9269-B.
