TITLE OF BILL:
An act to amend the correction law, in relation to rules and regulations
for strip searches in correctional facilities
PURPOSE OR GENERAL IDEA OF BILL:
Provides for rules and regulations for strip searches in correctional
facilities.
SUMMARY OF PROVISIONS:
Section 1 Amends Correction Law Section 45 to create a new subdivision
20 requiring the State Commission of Correction to promulgate rules and
regulations for standard procedures for the use of strip searches in a
correctional facility and states that no fewer than two staff members
shall be present for any strip search.
Section 2 sets the effective date 90 days after it shall have become law
and provides, effective immediately, all regulatory changes necessary
for the implementation of this act on the effective date are authorized
to be made and completed by such date.
JUSTIFICATION:
To prevent misconduct caused by staff in performing a strip search and
to protect the safety and rights of incarcerated individuals.

EFFECTIVE DATE:
