TITLE OF BILL:
An act to amend the town law, in relation to authorizing the town of
Chester, county of Orange to establish community preservation funds; to
amend the tax law, in relation to authorizing the town of Chester to
impose a real estate transfer tax with revenues therefrom to be deposit-
ed in said community preservation fund; and providing for the repeal of
certain provisions upon expiration thereof
PURPOSE:
To authorize the town of Chester, in Orange County, to establish commu-
nity preservation funds.
SUMMARY OF PROVISIONS:
Section 1: Amends the Town Law by adding section 64-1.
Section 2: Amends the Tax Law by adding a new article 31-A-4.
Section 3: Contains a severability clause.
Section 4: Sets effective date.
JUSTIFICATION:
This legislation would grant the Town of Chester the authority to estab-
lish Community Preservation Funds dedicated to the protection of its
farmland and open spaces. The Town of Chester views this initiative as a
significant milestone in its efforts to safeguard and preserve its rural
character for future generations.

FISCAL IMPLICATIONS:
None to the state.
EFFECTIVE DATE:
This act shall take effect immediately; provided, however, that section
two of this act shall take effect on the ninetieth day after it shall
have become a law and shall expire December. 31, 2045, when upon such
date the provisions of such section shall be deemed repealed.
