TITLE OF BILL:
An act to amend the environmental conservation law and the public health
law, in relation to establishing air quality standards for lead in ambi-
ent air, soil-lead hazard standards for lead-contaminated soil, and
dust-lead hazard standards and dust-lead clearance levels for floors and
windows and window troughs

PURPOSE OR GENERAL IDEA OF BILL:
To protect the public health, especially that of children, by establish-
ing stricter standards for lead dust contamination in soil and on floors
and windowsills.
 
SUMMARY OF PROVISIONS:
Provides for the establishment of air quality standards for lead in
ambient air, soil-lead hazard standards for lead-contaminated soil, and
dust-lead hazard standards and dust-lead clearance levels for floors and
windows and window troughs.
 
JUSTIFICATION:
There is no amount of lead exposure that is safe, particularly for chil-
dren. The past few years have seen action at the Federal EPA Level and
as well in various states to establish standards that recognize what
science, health and life experience tell us. Thus, this bill sets air
quality standards for lead in ambient air, soil-lead hazard standards
for lead-contaminated soil, and dust-lead hazard standards and dust-lead
clearance levels for floors and windows and window troughs
 
PRIOR LEGISLATIVE HISTORY:
In 2022, Similar Legislation--A5541-B passed both chambers and was
vetoed. This bill Passed the Senate in 2024.
 
FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS:
None.
 
EFFECTIVE DATE:
This act shall take effect on the 90th day after it shall have become
law.
