BILL NUMBER: S456
SPONSOR: PALUMBO

TITLE OF BILL:
An act to amend the correction law, in relation to the definition of a
sex offense

PURPOSE:
To expand the current definition of "sex offenses" under the corrections
law, including conviction for `sexually motivated felonies".

SUMMARY OF PROVISIONS:
Section 1 amends subdivision (i) paragraph (a) of subdivision 2 of
section 168-a of the correction law to add sexually motivated felonies
to the list of registrable offenses under current definitions under
section 168-a, 2 "Sex Offense".
Section 2 sets forth the effective date

JUSTIFICATION:
In 2007, the legislature established a sentencing enhancement when a
person commits certain enumerated crimes ("specified offenses") for the
purpose of his or her own direct sexual gratification, known as a sexu-
ally motivated felony. Due to an omission when coupling this new law
with section 168-a of the corrections law, aka "Meghan's Law, not all of
the sexually motivated crimes appear to be included as registrable
offenses. This technical amendment would clarify the correction law to
clearly include conviction for sexually motivated felonies as a registr-
able offense; it gaps inconsistences in the correction law and rightful-
ly provide justice for victims of sex offense.

LEGISLATIVE HISTORY:

FISCAL IMPLICATIONS:
None.

EFFECTIVE DATE:
This act shall take effect on the nineteenth day after it shall have
become law.
