TITLE OF BILL:
An act to authorize the granting of retirement service credit in the
optional twenty year retirement plan to Duane A. Palma for service as a
correction officer
 
PURPOSE:
The purpose of this bill is to allow the county of Monroe to offer an
optional twenty-year retirement plan to Duane A. Palma.
 
SUMMARY OF PROVISIONS:
Section one authorizes Monroe County to make participation in the
optional twenty-year retirement plan as established by section 552 and
553 of the retirement and social security law.
Section two provides for the election of filing the request.
Section three specifies that all costs associated with this act shall be
borne by Monroe County.
Section four sets the effective date.
 
JUSTIFICATION:
Deputy Palma is currently employed with the Monroe County Sheriff's
Department Road Patrol. He has of twenty years of law enforcement
including agencies with the Rochester Police Department, Greece Police
Department, as well as the Monroe County Sheriff's Office Jail Bureau.
Approximately two years ago he transferred back to the Monroe County
Sheriff's Department from the Greece Police Department informed that his
prior Jail bureau service in the 89N retirement system was certified on
the front end of their retirement. Because other members of his employ-
ment tier have successfully used this time to retire, Deputy Palma
anticipated it would apply in the future. For reasons not ascribable to
his own negligence, Deputy Palma was denied credit time for his service.
This bill allows Deputy Palma the option to Join this retirement plan to
rectify this error.,
 
LEGISLATIVE HISTORY:

FISCAL IMPLICATIONS:
If this bill is enacted during the 2024 Legislative Session, there will
be an immediate past service cost of approximately $177,000 which will
be borne by the County of Monroe as a one-time payment. This estimate
assumes that payment will be made on February 1, 2025. If the County of
Monroe elects to amortize this cost over a five-year period, the cost
for each year including interest would be $39,600.
 
EFFECTIVE DATE:
This act shall take effect immediately.
