TITLE OF BILL:
An act in relation to authorizing the state to exchange parcels of land
located in the city of Yonkers, county of Westchester, with 140 Warbur-
ton LLC
PURPOSE:
The purpose of this bill is to authorize New York State to exchange
specific parcels of State-owned land located in the City of Yonkers,
outlined in this bill, for parcels of land owned by 140 Warburton LLC.
SUMMARY OF PROVISIONS:
Section 1 of the bill authorizes the State Commissioner of General
Services to transfer ownership of State land, outlined in Section 2, to
140 Warburton LLC in exchange for land of equal or greater market value
owned by 140 Warburton LLC.
Section 2 provides the legal description of the State lands that the
State will exchange to 140 Warburton LLC.
Section 3 states that, in exchange for the State-owned land outlined in
Section 2, 140 Warburton LLC will transfer ownership of land of equal or
greater market value to the State.
Section 4 requires the State Adjutant General to add specific terms to
the land exchange contract between the State and 140 Warburton LLC. The
contract will not be binding until the Attorney General and the State
Comptroller approve the contract.
Section 5 requires 140 Warburton LLC to apply for the land exchange with
the Office of General Services within one year of the effective date of
this bill, or the Office of General Services cannot transfer State-owned
land to 140 Warburton LLC.
Section 6 is the effective date.
JUSTIFICATION:
The New York State Office of General Services, the New York State Divi-
sion of Military Affairs, and 140 Warburton LLC have requested that the
Legislature authorize this land exchange. The parcels of land involved
in the exchange are small, and 140 Warburton LLC's proposed land is at
least equivalent in size to the State's proposed land.
