TITLE OF BILL:
An act to amend part PP of chapter 58 of the laws of 2020 amending the
environmental conservation law relating to expanded polystyrene foam
container and polystyrene loose fill packaging ban, and amending the
state finance law relating to moneys collected for violations of the
expanded polystyrene foam container and polystyrene loose fill packaging
ban, in relation to extending the effectiveness thereof
 
PURPOSE OR GENERAL IDEA OF BILL:
The purpose of this bill is to extend the ability for counties to retain
fees relating to the enforcement of the polystyrene container and loose
fill ban.
 
SUMMARY OF PROVISIONS:
Section 1 of the bill would extend, for five years, until January 1,
2030, the ability for counties to retain any fines collected by a
proceeding to enforce the polystyrene packaging foam container and loose
fill ban which was initiated by the county.
 
JUSTIFICATION:
The polystyrene foam container and loose fill ban, enacted in 2010, has
helped reduce the amount of waste and litter in New York and improved
the recyclability of packing materials overall. This bill is necessary
to ensure that counties retain an incentive to help with enforcement of
this act.

This act shall take effect immediately.
