TITLE OF BILL:
An act authorizing the town of East Hampton to alienate and convey
certain parcels of land used as parkland for the purpose of a Suffolk
County roadway improvement project
 
PURPOSE:
Authorizes the town of East Hampton to alienate and convey certain
parcels of land used as parkland for the purpose of a Suffolk County
roadway improvement project.
 
SUMMARY OF PROVISIONS:
Section 1. Authorizes the town of East Hampton to discontinue as park-
land a parcel located at the intersection of Three Mile Harbor Road and
Springs Fireplace Road and convey it to the Suffolk County for the
purposes of a roadway improvement project.
Section 2. Provides that authorization to discontinue said parkland
shall only be effective on the condition that the town of East Hampton
acquire and dedicate a parcel of land located at 16 Swamp Road as park-
land, provided the Town has never used such lands for public open space
or park purposes.
Section 3. Describes the metes and bounds of the parklands to be alien-
ated.
Section 4. Describes the metes and bounds of the parcel that shall be
acquired and dedicated as parklands.
Section 5. Regards to acquiring the fair market value of the lands being
discontinued and the lands to be acquired.
Section 6. States that if the town of East Hampton received any funding
support or assistance from the federal government for the purchase,
maintenance or improvement of the parklands set forth in section 3 of
this act, the discontinuance and alienation of such parkland authorized
by the provisions of this act cannot occur until the town of East Hamp-
ton complied with any federal requirements related to the alienation or
conversion of parklands, including satisfying the Secretary of the Inte-
rior deems necessary to assure the substitution of other lands shall be
the equivalent in fair market value and usefulness to the lands being
alienated or converted.
Section 7. Sets the effective date.
 
JUSTIFICATION:
Suffolk County will be undertaking a roadway improvement project for
CR40 (aka Three Miler Harbor Road) from Collins Avenue to Copeces Lane.
There is a point on CR40 that intersects with CR41 (Springs Fireplace
Road). This location routinely experiences traffic delays and congestion
for vehicles that are southbound on CR41 and need to cross over to CR40.
In addition, traffic will back up on CR40 southbound while cars are
crossing over from CR41. As such, the town of East Hampton is supportive
of the project including a roundabout at the intersection of CR40 and
CR41.
The Suffolk County Department of Public Works recently conducted a
public information session to present its conceptual project plans.
While the proposed plans currently do not recommend including a rounda-
bout, the County did not rule it out as a possibility to address traffic
flow issues at this intersection. One of the issues, however, is that
the land that would be needed to construct a roundabout is designated
parkland.
Accordingly, the town of East Hampton has requested the introduction of
this legislation which is necessary to enable the alienation of the
parkland at this location (SCTM 300-163-3-7) and swap it for a compara-
ble parcel of land located at 16 Swamp Road (STM 300-2-6-2) for the
purposes of constructing a roundabout.
