TITLE OF BILL:
An act to amend chapter 429 of the laws of 2021 amending the general
business law relating to the applicability of the security guard act of
nineteen hundred ninety-two to facilities owned by a public sports
venue, in relation to the effectiveness thereof
 
PURPOSE OR GENERAL IDEA OF BILL:
Extends for an additional three years the exemption from the Security
Guard Act for public entities that hire security guards or third-party
security providers who supply such security guards on a temporary basis
for less than 15 days each year to the tenants of a publicly owned
sports venue located within Erie County with a capacity of at least
60,000 people
 
SUMMARY OF PROVISIONS:
Section one of the bill amends the effective date of Chapter 429 of the
laws of 2021 providing an exemption from the Security Guard Act for
another three years.
§ 2. Establishes the effective date.
 
JUSTIFICATION:
The waiver provisions included within the Security Guard Act recognize
the hiring challenges faced by public entities who require such services
on a limited basis. This law was amended in 2022, to include third-party
security providers of such services that have been contracted by a
tenant of a publicly owned sports venue in Erie County, having a capaci-
ty of at least 60,000 people. The amendment also provided that the
third-party security provider is only exempt so long as at least 50
percent of their security guards are licensed under the Security Guard
Act. This bill recognizes the necessity of maintaining such an exemption
for this sports venue by extending the sunset date for another three
years.
