TITLE OF BILL:
An act to amend the vehicle and traffic law, in relation to reporting
accidents involving electric scooters and bicycles with electric assist
PURPOSE OR GENERAL IDEA OF BILL:
Requires accident reports to specify where e-bikes and e-scooters are
involved.
SUMMARY OF PROVISIONS:
Section 1 amends subdivision 1 of section 603 of the vehicle and traffic
law to require accident reports to include information about the type of
vehicle involved in crashes resulting in injuries, including electric
scooters and bicycles with electric assist.
Section 2 amends subdivision 1 of section 603-a of the vehicle and traf-
fic law to include bicycles with electric assist and electric scooters
in the types of vehicles investigated in crashes.
Section 3 amends section 604 of the vehicle and traffic law to require
reports of accidents to indicate whether accidents involved motor vehi-
cles, electric scooters, or bicycles with electric assist.
Section 4 amends subdivisions b and c of Section 605 includes electric
scooters and bicycles with electric assist in the requirement to report
accidents in which any person is killed or suffers serious injury.
This act shall take effect one year after being signed into law
JUSTIFICATION:
Concerns about accidents involving e-bikes and e-scooters have grown in
recent months, along with concerns around individuals using e-bikes
being unfairly targeted. However, New York currently lacks information
on the makeup of accidents involving e-bikes as the state's accident
reports do not mention e-bikes. This bill will include e-bike and
e-scooters in accident reports that already specify the use of other
forms of transportation and follows NTSB guidance on micro-mobility
devices.

EFFECTIVE DATE:
This act shall take effect one year after being signed into law.
