TITLE OF BILL:
An act authorizing the town of New Windsor to alienate certain parklands
for use as a sewer treatment plant and to dedicate other lands as
replacement parklands
 
PURPOSE:
To authorize the town of New Windsor to alienate certain parklands for
use as a sewer treatment plant and to dedicate other lands as replace-
ment parklands
 
SUMMARY OF PROVISIONS:
Section 1. Authorizes the town of New Windsor to discontinue certain
parklands for the purposes of construction and expansion of the town's
new sewer treatment plant.
Section 2. The authorization in Section 1 is conditional upon the town
of New Windsor dedicating the lands described in section four as park-
land provided that the town of New Windsor has never used such lands for
public open space or park purposes.
Section 3. Describes the specific parcel of land that the town of New
Windsor is authorized to discontinue as parklands.
Section 4. Describes the replacement land for use as parklands.
Section 5. Section regarding the fair market value of the lands being
discontinued and the lands to be acquired.
Section 6. States that if the town of New Windsor receives any funding
or assistance from the federal government for the purchase, maintenance,
or improvement of the lands held in public trust, then the discontin-
uance and alienation of such lands held in public trust, as authorized
in section one of the act, cannot occur until the town of New Windsor
complies with any federal requirements related to the alienation or
conversion of such public trust lands.
Section 7. Sets the effective date.
 
JUSTIFICATION:
This bill will allow the town of New Windsor, in Orange County, New
York, to alienate certain parklands and to dedicate other lands as
replacement parklands. This legislation was requested by the town of New
Windsor and will allow them to construct and expand their sewer treat-
ment plant. This exchange will also require the town to dedicate the
difference of the fair market value of the lands to be alienated and the
lands to be dedicated for the acquisition of additional parklands and/or
capital improvement to existing park and recreational facilities.
