TITLE OF BILL:
An act to amend the elder law, in relation to social model adult day
services programs
 
PURPOSE OR GENERAL IDEA OF BILL:
The purpose of this bill is to enhance the State Office for the Aging's
(SOFA) oversight capacity of social adult day care programs.
 
SUMMARY OF PROVISIONS:
Section one specifies that the rules and regulations promulgated by the
Director of SOFA apply to all social adult day care programs, regardless
of their source of funding. This section requires the Director to
inspect each social adult day care program to ensure the program has met
the standards and requirements established by the Director prior to
operating and no less than once every five years. No social adult day
care program would be eligible for funding under section 215 of the
elder law or any other public funding. This section would also require
each social adult day care program to conduct an annual self-certifica-
tion beginning January first, 2030.
Section two sets the effective date.
 
JUSTIFICATION:
In 2023, the Assembly Aging Committee held a hearing to review and exam-
ine the oversight of social adult day care programs. The Committee
sought to gather testimony on the current oversight of social adult day
care programs and ways to improve such programs for participants, their
caregivers, and providers. Based on the feedback from stakeholders, this
bill seeks to enhance and strengthen the State Office for the Aging's
authority to regulate and oversee social adult day care programs.
