TITLE OF BILL:
An act to amend the public officers law, in relation to the qualifica-
tions for holding the office of assistant county attorney in the county
of Herkimer
 
PURPOSE OR GENERAL IDEA OF BILL:
To waive the residency requirement for the Herkimer County Assistant
Attorney.
 
SUMMARY OF PROVISIONS:
Section 1-Amends section 3 of the public officers law is amended by
adding a new subdivision 73, which waives the residency requirement for
Herkimer County Assistant Attorney, provided that
Section 2 - Provides the effective date.
 
JUSTIFICATION:
The County of Herkimer currently has limited flexibility to fill the
position of Assistant County Attorney due to a residency requirement. A
Resolution was adopted at the county level which would expand the resi-
dency requirement by asking the state to act on waiving this requirement
providing that the candidate reside in an adjoining county. This is
particularly important for Herkimer County at a time when hiring and
maintaining staff remains a challenge.

EFFECTIVE DATE:
This act shall take effect immediately.
