TITLE OF BILL:
An act in relation to authorizing the village of Haverstraw to alienate
and discontinue the use of certain parklands
 
PURPOSE:
This bill would authorize the Village of Haverstraw to alienate certain
parklands, and obtain other parklands in its stead, and to convey prop-
erty interests in such lands to Haverstraw Community Chair Factory, LLC.
 
SUMMARY OF PROVISIONS:
Section 1: Would authorize the Village of Haverstraw to alienate certain
parklands, and obtain other parklands in its stead, and to convey prop-
erty interests in such lands to Haverstraw Community Chair Factory, LLC.
Section 2: States that the authorization granted in Section 1 would only
be effective upon the condition that the Village of Haverstraw dedicate
an amount, equal to or greater than the amount of the fair market value
of parklands being alienated, toward the purchase of new parklands
and/or capital improvements to existing parkland and recreation facili-
ties.
Section 3: Sets forth the certain plot, piece or parcel of land being
alienated in Section 1.
Section 4: If the Village of Haverstraw receives any federal assistance
or funds for the purchase, maintenance or improvement of said parcel of
land enumerated in Section 1 herein, the alienation of such parklands
authorizes by Section 1, herein, shall not occur until the Village of
Haverstraw has complied with any and all federal requirements pursuant
to the alienation or conversion of parkland, including satisfying all of
the conditions set forth by the secretary of the interior.
Section 5: Effective Date
 
JUSTIFICATION:
The Village of Haverstraw has been undergoing significant improvements
to their parks and waterfront, and this bill would allow the Village to
alienate a certain portion of parkland, while simultaneously obtaining a
portion equal to or larger than that being alienated. In doing so, the
Village of Haverstraw will be building and providing more housing to
their residents, along with continuing improvements to their parks and
public spaces.
