TITLE OF BILL:
An act to amend the state law, in relation to establishing congressional
districts; and to repeal article 7 of such law relating thereto
PURPOSE:
The purpose of this bill is to establish 26 congressional districts in
New York State in accordance with a court order decision in the Anthony
S. Hoffmann et al. v. New York State Independent Redistricting Commis-
sion et al.
SUMMARY OF PROVISIONS:
This bill repeals the existing Article 7 of State Law and adds a new
Article 7 establishing new boundaries for New York State's 26 Congres-
sional districts.
Vacancies in congressional districts shall be filled using the bounda-
ries existing prior to this bill's enactment through January 1, 2025, at
which time vacancies shall be filled using the new boundaries estab-
lished by this act.
JUSTIFICATION:
On December 12, 2023, the New York State Court of Appeals ordered that
the New York State Independent Redistricting Commission shall prepare a
redistricting plan to establish new congressional districts and shall
submit to the legislature such plan and the implementing legislation
therefor on or before February 28, 2024.
This bill establishes new congressional districts for New York State.
The districts are based on population figures from the 2020 Federal
Census. All districts comply with the United States and New York State
Constitutions as well as the requirements of the Federal Voting Rights
Act.
