TITLE OF BILL:
An act to amend the public officers law, in relation to waiving the
residency requirement for certain assistant district attorney positions
within Saratoga County
 
PURPOSE:
Permits residents outside of Saratoga county to hold the position of
assistant district attorney in Saratoga County.
 
SUMMARY OF PROVISIONS:
Section one adds subdivision 74 to section 3 of the public officers law
allowing residents of counties which adjoin Saratoga County to serve as
district attorneys in Saratoga County. This provision does not apply to
the position of chief assistant district attorney.
Section two provides the effective date.
 
JUSTIFICATION:
This bill has been introduced at the request of the Saratoga County
District Attorney's Office. This legislation will allow Saratoga County
to expand its pool of eligible applicants and be able to hire qualified
individuals from adjoining counties to hold the position of assistant
district attorney in Saratoga County. Similar authorizations have been
provided to multiple counties across NYS.
