TITLE OF BILL:
An act to amend the alcoholic beverage control law, in relation to an
exemption for certain property from the prohibition of alcohol sales
within a certain distance of a church
PURPOSE OR GENERAL IDEA OF BILL:
To amend the alcoholic Beverage Control Law by enabling an establishment
located within two-hundred feet of a church to be eligible to apply for
a liquor license from the NYS Liquor Authority.
SUMMARY OF PROVISIONS:
Section one of this bill amends subdivision 7 of section 64 of the Alco-
hol Beverage Control law by adding a new paragraph describing the metes
of the property at One Wall Street for the purposes of exempting such
premises from the prohibition of holding a license within two hundred
feet of a church.
Section two sets the effective date of the bill.
JUSTIFICATION:
Printemps America Inc is seeking to apply for an on-premise liquor,
wine, beer and cider license for a location at One Wall Street/3 New
Street but is currently ineligible from applying due to the prohibition
in subdivision 7 of section 64 of the Alcohol Beverage Control law,
which stipulates that liquor licenses are prohibited from being issued
within two hundred feet of a church. Printemps has consulted with and
gained permission from the religious institution in question, Trinity
Church Wall Street, and has received unanimous conditional approval from
Manhattan Community Board 1 for a liquor license pursuant to meeting the
criteria outlined by the Community Board. Representatives of the Commu-
nity Board have expressed that the Board has no objections to enactment
of this bill. Based on these-considerations, this legislation seeks to
grant an exemption to subdivision 7 of section 64 of the Alcohol Bever-
age Control law for Printemps America Inc for this location.

FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS:
This legislation will help generate sales, excise, and property tax
revenue.

This act shall take effect immediately.
