TITLE OF BILL:
An act to amend the judiciary law, in relation to hope cards and to
amend a chapter of the laws of 2023 amending the judiciary law relating
to enacting the "hope card act", as proposed in legislative bills
numbers S. 5935 and A. 5040, in relation to the effectiveness thereof
 
PURPOSE:
This is a chapter amendment to L.2023, ch. 538. It clarifies provisions
concerning the form and effect of a hope card, and it modifies the
effective date of the original chapter.
 
SUMMARY OF PROVISIONS:
Section 1 modifies multiple provisions of the underlying chapter. Most
notably, it clarifies that a court may issue a hope card as either a
physical, wallet-sized card or as a digital image, delivered via text
message or other electronic communication, of the final order of
protection. The underlying chapter authorized a physical card but not a
digital one.
Section 2 extends the effective date of the original chapter, from 180
days after enactment to one year after enactment.
Section 3 is the effective date.
 
EXISTING LAW:
None.
 
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.
 
LEGISLATIVE HISTORY:
Chapter amendment to Chapter 538 of the Laws of 2023. S.5935 and A.5040
passed the Senate and Assembly, respectively, in June 2023.

EFFECTIVE DATE:
This act shall take effect immediately; provided, however, that section
one of this act shall take effect on the same date and in the same
manner as a chapter of the laws of 2023 amending the judiciary law
relating to enacting the "hope card act", as proposed in legislative
bills numbers S. 5935 and A. 5040, takes effect.
