TITLE OF BILL:
An act to amend the executive law, in relation to establishing the New
York Asian American and Pacific Islander commission and providing for
its duties; to amend a chapter of the laws of 2023 amending the execu-
tive law relating to establishing the New York Asian American and Pacif-
ic Islander commission, as proposed in legislative bills numbers S.
1051-A and A. 3301-A, in relation to the effectiveness thereof; and to
repeal section 295-a of the executive law relating thereto
 
PURPOSE:
This is a chapter amendment that makes changes to provisions of L.2023,
c.639, to move the New York Asian American and Pacific Islander commis-
sion from existing under the Division of Human Rights to the Department
of State, lowering its membership to thirteen members, making its find-
ings recommendations, and setting a five year sunset.
 
SUMMARY OF PROVISIONS:
Section one repeals Section 295-a of the Executive Law, which estab-
lished a New York Asian American and Pacific Islander commission under
the Division of Human Rights.
Section 2 creates a new section 94-d of the Executive Law to establish a
New York Asian American and Pacific islander commission under the
Department of State. This thirteen-member commission, with seven
appointees from the Governor and six from the Legislature will make
recommendations on policies to improve the well-being of Asian Americans
and Pacific Islanders, make these communities aware of available state
programs and resources, and ways to increase public awareness of Asian
American and Pacific Islander culture and concerns. This commission
shall report annually to the Governor and the Legislature.
Section 3 amends the effective date of Chapter 639 to set a five-year
sunset. Section 4 sets the effective date.

None.
 
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.
 
LEGISLATIVE HISTORY:
Chapter amendment to Chapter 636 of the Laws of 2023. S.1051-A and
A.3301-A both passed the Senate and Assembly in June 2023.
 
FISCAL IMPLICATIONS:
None
 
EFFECTIVE DATE:
This act shall take effect immediately; provided, however, that sections
one and two of this act shall take effect on the same date and in the
same manner as a chapter of the laws of 2023 amending the executive law
relating to establishing the New York Asian American and Pacific Islan-
der commission, as proposed in legislative bills numbers S.1051-A and A.
3301-A, takes effect.
