TITLE OF BILL:
An act to amend the general business law, in relation to the sale of
bicycles with electric assist and micromobility devices
PURPOSE:
The purpose of this legislation is to address the increasing number of
electric bicycle and scooter incidents in cases of accidents or damage
by requiring a notice of use on such equipment
SUMMARY OF PROVISIONS:
Section 1 amends the general business law to add new section 391-cc,
which states that no manufacturer shall sell any bicycle or scooter with
electric assist and/or are electric powered without supplying a notice
sticker on such bicycle or scooter. This section defines the term
"micromobility" and provides the exceptions for certain transportation
devices.
The notice must be printed in English and the two most common non-Engl-
ish languages, and shall be available to any purchasing firm, corpo-
ration, or person upon request. Additionally, no business is permitted
to sell a bicycle or scooter with electric assist and/or are electric
powered without having a notice attached. Such business shall be subject
to a fine of up to $250 per stocking unit on the first offence and up to
$1000 per stocking unit for each subsequent offense.
Section 2 provides the effective date.
JUSTIFICATION:
As use of electric bicycles and scooters. otherwise known as e-bikes,
has increased - the number of e-bike related accidents on sidewalks has
also increased. It has been reported that more users of e-bikes are
riding on the sidewalks, instead of the designated bike lanes, resulting
in pedestrian accidents and injuries.
This legislation aims to mitigate the issue of these incidents by
providing notice on the equipment that informs cyclists of rules while
using these bikes. Under this bill, businesses are prohibited from sell-
ing e-bikes without this notice and will be met with a fine if these
notices are not under compliance with the law.

EFFECTIVE DATE:
This act shall take effect on the one hundred and eightieth day air
shall have become law. Effective immediately, the addition. amendment,
and/or repeal of any rule or regulation for the implementation of this
act on its effective date is authorized to he made on or before such
date.
