TITLE OF BILL:
An act to amend the alcoholic beverage control law, in relation to a
license to sell liquor at retail for consumption on certain premises
PURPOSE:
To provide an exemption that would allow for an on-premise liquor
license from the New York State Liquor Authority to be granted at 269
Hempstead Avenue in the Village of Malverne.
SUMMARY OF PROVISIONS:
Section 1: Amends subdivision 7 of section 64 of the alcoholic beverage
control law to add a new paragraph (e-15) to allow the State Liquor
Authority to issue a retail license for on-premises consumption for a
premise located within 200 feet of a building occupied as a place of
worship within the metes and bounds as provided in this legislation.
Section 2: Provides the effective date.
JUSTIFICATION:
Section 64 of New York State's Alcoholic Beverage Control law prohibits
retail licenses for on-premises consumption within 200 feet of places of
worship, but also provides multiple exemptions to this rule. This legis-
lation would allow the an establishment at the premises of 269 Hempstead
Ave, Malverne, NY, to apply for an on-premise liquor license from the
New York State Liquor Authority.
