TITLE OF BILL:
An act to amend chapter 154 of the laws of 1921, relating to the port
authority of New York and New Jersey, in relation to military leave for
all represented and non-represented persons employed by the port author-
ity of New York and New Jersey
PURPOSE:
To provide the rights and benefits provided under New York State Mili-
tary Law section 242, to employees of the Port Authority of New York and
New Jersey.
SUMMARY OF PROVISIONS:
Section 1 Provides Definitions
Section 2 Provides Leave of absence for Port Authority of NY & NJ
employees while engaged in performance of ordered military duty
Section 3 Provides Leave of absence for Port Authority of NY & NJ
employees while attending service schools or training
Section 4 Provides employment rights for Port Authority of NY & NJ
employees. Protecting them from diminution of time service, increment,
vacation, or holiday privileges, or any other right or privilege, by
reason of such absence, or be prejudiced, by reason of such absence,
with reference to continuance in office or employment, reappointment to
office, re-employment, reinstatement, transfer or promotion.
Section 5 Provides Port Authority of NY & NJ employees pay for military
duty, while going to and returning from such duty, not exceeding a total
of thirty days or twenty-two working days, whichever is greater, in any
one calendar year and not exceeding thirty days or twenty-two working
days, whichever is greater, in any one continuous period of such
absence. Furthermore it provides every Port Authority of NY & NJ employ-
ee who served in a combat theater or combat zone of operations as docu-
mented by a copy of his or her DD214, certificate of release or
discharge from active duty, or other applicable department of defense
documentation, his or her salary or other compensation as such for any
and all periods of absence while utilizing any healthcare related
services related to such duty, not exceeding five working days, in any
one calendar year. Section 6 Provides Port Authority of NY & NJ rights
and sets contribution amounts under retirement systems
JUSTIFICATION:
Providing Port Authority employees these benefits would provide parody
between them and all other New York State public officers and employees,
which include every person, by whatsoever title, description or desig-
nation known, who receives any pay, salary or compensation of any kind
from the state or a municipal corporation or any other political subdi-
vision thereof, or who is in any department of the state or in the
service of any public authority. An oversight in the implantation of
Military Law 242 has excluded employees of the Port Authority of New
York and New Jersey from these important rights and benefits.
