TITLE OF BILL:
An act to amend the alcoholic beverage control law, in relation to
exempting certain parcels of land from licensing restrictions prohibit-
ing manufacturers, wholesalers and retailers of alcoholic beverages from
sharing an interest in a licensed premises
PURPOSE:
Relates to exempting the Smith Center for the Arts from licensing
restrictions prohibiting manufacturers, wholesalers and retailers of
alcoholic beverages from sharing an interest in licensed premises.
SUMMARY OF PROVISIONS:
Section 1: Paragraph A of subdivision 1 of section 101 of the alcohol
beverage control law is amended by adding a new subparagraph XVIII.
Section 2: Paragraph A of subdivision 13 of section 106 of the alcohol
beverage control law is amended by adding a new subparagraph XXIII.
Section 3: Establishes an immediate effective date.
JUSTIFICATION:
New York State currently restricts holders of alcohol manufacturing
licenses from having an interest in a retail license. Exemptions to this
law are occasionally made to certain properties to support economic
development. These exemptions are narrow and specific, using metes and
bounds descriptions to prevent any undue market influence.
This legislation seeks technical amendments to the ABC law in order to
align the metes and bounds for the Smith Center for the Arts in Geneva,
NY, that has been approved for a liquor license.
The Smith is governed by a volunteer Board of Directors, and they are
currently limited by ABC law and cannot sit members of the Board of
Directors who currently hold a manufacturer's license. As a volunteer
board, this limits the quality and quantity of candidates who can serve
on the Board of Directors and hampers the Smith's objective of providing
"quality performing arts and cultural opportunities for area residents
and regional visitors."
This legislation would open the pool of people that can serve on the
Board of Directors, providing for the highest quality Board that is
committed to serving the community they live in and driving economic
development in Geneva and the surrounding Finger Lakes area through the
cultural experience of the Smith.
