BILL NUMBER: S4495
SPONSOR: GOUNARDES

TITLE OF BILL:
An act to amend the civil practice law and rules, in relation to
increasing certain fixed fees for services provided by sheriffs

PURPOSE OR GENERAL IDEA OF BILL:
To modernize the fee schedule for certain services provided by New York
City marshals and sheriffs.

SUMMARY OF PROVISIONS:
Section one of the bill amends section 8011 of the Civil Practice Law
and Rules to increase certain fixed fees for sheriffs and marshals for
the performance of their duties.
Section two sets the effective date.

JUSTIFICATION:
New York City Marshals and Sheriffs are paid for their service with a
predetermined schedule of fees set in statute. These fees are currently
outdated and due to variables such as inflation are no longer viable.
Neither the Sheriffs nor the Marshals have seen their fees increase
since 2002. This legislation would update certain fees that are the most
undervalued compared to what the service being performed requires.

PRIOR LEGISLATIVE HISTORY:
2022: S9173 - Referred to judiciary

FISCAL IMPLICATIONS:
TBD

EFFECTIVE DATE:
This act shall take effect on the thirtieth day after it shall have
become a law.
