TITLE OF BILL:
An act to amend the executive law, the multiple dwelling law, the multi-
ple residence law and the administrative code of the city of New York,
in relation to requiring the installation of smoke detectors in common
places of certain dwellings
 
PURPOSE:
The purpose of this bill is to make residential buildings safe from fire
hazards.
 
SUMMARY OF PROVISIONS:
Section 1. Subdivision 5-b of § 378 of the Executive Law is amended to
require every multiple family dwelling, except for a property owned or
operated by a public housing authority subject to federal safety and
inspection standards and every dwelling owned as a condominium or coop-
erative in New York used as a residence shall have installed an opera-
ble, clearly audible single station smoke detecting device or devices in
common spaces.
Section 2. Effective date
 
JUSTIFICATION:
On January 26, 2023, shortly after 5 p.m., a fire broke out at 4055
Carpenter Avenue in the Bronx. Approximately 200 fire fighters and other
personnel rushed to the scene to fight the fire. Four people were
injured, including three-firefighters. Many residents have been
displaced.
It was determined that the fire had spread to an adjoining building.
Residents had no idea that the fire was spreading because the building,
per existing law, was only required to have smoke detectors in individ-
ual apartments. This bill seeks to remedy that shortcoming. The bill
would ensure that smoke detectors are placed in common spaces throughout
multiple dwellings.
