TITLE OF BILL:
An act to amend the criminal procedure law, in relation to the effect of
termination of criminal actions and proceedings against a minor
PURPOSE OR GENERAL IDEA OF BILL:
Allows for minors with no prior arrest or criminal records, who are
found innocent or have a case against them dismissed, to have their
arrest record, fingerprints, and photographs expunged.
SUMMARY OF PROVISIONS:
Section 160.60 of the criminal procedure law, as amended by chapter
877of the laws of 1976, is amended to read as follows: § 160.60 Effect
of termination of criminal actions in favor of the accused.
JUSTIFICATION:
Any minor without a prior arrest or criminal record, who has been
arrested with or without warrant, and either being found innocent or
having their case dismissed, should have the slate wiped clean, whereas
having an arrest or criminal record could negatively impact them in some
situations.
