TITLE OF BILL:
An act to amend the general business law, in relation to the sale of
digital electronic equipment and providing diagnostic and repair infor-
mation; and to amend a chapter of the laws of 2022 amending the general
business law relating to the sale of digital electronic equipment and
providing diagnostic and repair information, as proposed in legislative
bills numbers S. 4104-A and A. 7006-B, in relation to the effectiveness
thereof
 
PURPOSE:
This is a chapter amendment that makes changes to a chapter of the laws
of 2022, enacting S.4104A and A.7006B,
 
SUMMARY OF PROVISIONS:
This legislation amends the underlying chapter by altering the defi-
nition of original equipment manufacturers (OEMs), makes the bill effec-
tive only for products manufactured for the first time, and first sold
or used in New York on or after July first, 2023 and requires that
consumers be provided with information on warranties when they bring a
device to an independent repair provider. It also creates exemptions for
security devices, industrial equipment, and ensures that the intellectu-
al property rights of OEMs are protected
 
JUSTIFICATION:
The Executive expressed a belief that these changes would improve secu-
rity and safety for consumers while still protecting their ability to
get their devices repaired at a fair and reasonable price. The Execu-
tive believed that the new effective date will simplify compliance for
businesses impacted by this bill.

EFFECTIVE DATE:
This act shall take effect immediately; provided, however that section
one of this act shall take effect on the same date and in the same
manner as a chapter of the laws of 2022 amending the general business
law relating to the sale of digital electronic equipment and providing
diagnostic and repair information, as proposed in legislative bill
numbers. S.4104A and A.7006B takes effect.
