TITLE OF BILL:
An act to amend the criminal procedure law, in relation to designating
uniformed court officers in the town of Busti, county of Chautauqua, as
peace officers
 
PURPOSE OR GENERAL IDEA OF BILL:
This bill would designate the uniformed court officers of the Town of
Busti, as peace officers.
 
SUMMARY OF PROVISIONS: Section 1. Amends Section 2.10 of the Criminal
Procedure law by adding a new subdivision 87 to provide that employees
of the Town of Busti, in Chautauqua County, serving as uniformed court
officers in the justice court of such town, may be designated as peace
officers; provided, however, that nothing in this subdivision shall be
deemed to authorize such employees to carry, possess, repair or dispose
of a firearm unless the appropriate license therefore has been issued
pursuant to section 400.00 of the penal law.
Section 2. Provides that the act shall take effect immediately. *
 
JUSTIFICATION:
The town of Busti, by unanimous vote, adopted a formal resolution in
support of legislation that would designate its uniformed court officers
as peace officers. A peace officer designation will both allow a
uniformed court officer to maintain his or her peace officer status and
certification for future employment and decrease liability for the town
of Busti by filling the position from a pool of peace officer certified
candidates.
