TITLE OF BILL:
An act to amend the social services law, in relation to window coverings
required in child day care centers
 
PURPOSE:
This is a chapter amendment that makes changes to provisions of L.2022,
c.792, to clarify provisions relating to window coverings in child care
centers.
 
SUMMARY OF PROVISIONS:
This legislation amends the underlying chapter by removing the require-
ment that the provisions of this legislation apply to agency boarding
homes or group homes. The legislation amends the requirements for child
care centers that have window coverings in place at the time of the
effective date to require that they ensure strangulation hazards are
secured and inaccessible as currently required by the regulations issued
by the Office of Children and Family Services. Lastly, the legislation
modifies enforcement provisions to reflect a child day care center rath-
er than an individual person.
 
EXISTING LAW:
None.
 
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.
 
LEGISLATIVE HISTORY:
Chapter amendment to Chapter 792 of the Laws of 2022. S.6900 and
A.2150-A both passed the Senate and Assembly, respectfully, in May 2022
and January 2022.
 
FISCAL IMPLICATIONS:
None.
 
EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2022 relating to establishing Brendan's law; and
amending the social services law relating to requiring cordless window
coverings in child day care centers and certain other facilities, as
proposed in legislative bills numbers S.6900 and A.2150-A, takes effect.
