TITLE OF BILL:
An act to amend the executive law, in relation to prohibiting discrimi-
nation in government procurement
 
PURPOSE OR GENERAL IDEA:
To prohibit the use of discrimination in the government procurement
process
 
SUMMARY OF SPECIFIC PROVISIONS:
Section 1 of the bill amends subdivision 3 of section 290 of the execu-
tive law to add "government procurement" to the legislative intent of
the Human Rights Law.
Section 2 of the bill amends section 296 of the executive law by adding
a new subdivision 20 to establish that it shall be unlawful discrimina-
tory practice for any agency or bureau of the state and any political
subdivision thereof to deny an government contracting or procurement
opportunity to any person, because of the actual or perceived, race,
creed, color, national origin, sexual orientation, military status,
sex,. age, disability, marital status, or familial status of such
person, or Of such person's business associates or partners, members,
stockholders, directors, officers, managers, superintendents, agents,
employees, suppliers or customers. Nothing in this subdivision shall
prohibit the state or any political subdivision thereof from establish-
ing policies to increase participation by a group of traditionally
underrepresented in government contracting or procurement.
Section 3 of the bill is the effective date.
 
JUSTIFICATION:
Neither New York State nor New York City have any law on the books that
protects against discrimination in the procurement process. This legis-
lation would amend the State Human Rights Law to codify such protection.

EFFECTIVE DATE:
This act shall take effect immediately.
