Existing law sets forth various requirements for public works, including, without limitation, requirements for: (1) procedures for the awarding of contracts by a public body; (2) the prevailing wage to be paid to certain workers employed in connection with the public work; (3) the retention of records relating to workers employed in connection with the public work and the wages and benefits paid to such workers; and (4) a contractor on a public work to establish certain fair employment practices. (Chapter 338 of NRS)
This bill provides that the provisions of existing law governing public works apply to any project for the development or improvement of broadband, telecommunication or fiber optic services for which public money has been provided and that is sponsored, financed, overseen or administered by a public body in the same manner as if the public body awarded a contract for the project, even if the project does not qualify as a public work.
Existing law requires a contractor or subcontractor engaged on a public work to maintain certain records concerning workers employed by the contractor or subcontractor in connection with the public work and the wages and benefits paid to such workers. Existing law requires a contractor or subcontractor to ensure that a copy of each such record for each calendar month is received by the public body awarding the contract not later than 15 days after the end of each month. (NRS 338.070) This bill requires a contractor or subcontractor engaged on a project described above who submits to a public body a copy of such a record to simultaneously submit a copy of the record to the Board of Directors of the Nevada State Infrastructure Bank.
