Existing law establishes provisions governing certain property rights and the conveyance of such rights. (Chapter 111 of NRS) This bill authorizes a broadband service provider to access and use a nonexclusive easement, public right-of-way or other property right granted to a public utility or a video service provider to install, maintain and operate equipment and facilities related to providing access to broadband Internet service if: (1) the broadband service provider is licensed or authorized to access a public right-of-way by a county, city or town; (2) the use of the easement by the broadband service provider does not materially affect the property interests of the property owner; and (3) the use of the easement by the broadband service provider does not materially affect the existing access and use of the easement by a public utility, a video service provider or other broadband service provider. This bill also defines certain terms relevant to broadband service providers.
