Existing law establishes the process by which a transportation network company may be issued a permit to operate by the Nevada Transportation Authority and imposes certain duties on common motor carriers. (Chapters 706 and 706A of NRS) With certain exceptions, existing law: (1) exempts a transportation network company from certain provisions governing common motor carriers; and (2) establishes that a permit issued to a transportation network company does not authorize a transportation network company or any driver or monitored autonomous vehicle provider to engage in any activity otherwise regulated pursuant to existing law. (NRS 706A.075, 706A.110, 706A.130) Section 3 of this bill instead establishes that a permit to operate a transportation network company: (1) imposes the duties of a common motor carrier on a transportation network company to the extent that such duties relate to transportation services; and (2) notwithstanding any other provisions of law, imposes vicarious liability on a transportation network company for the acts and omissions of a driver or monitored autonomous vehicle provider under certain circumstances.
Sections 1 and 2 of this bill make conforming changes to eliminate certain exemptions for a transportation network company from the provisions governing common motor carriers.
