Existing law governing common-interest communities is based on the Uniform Common-Interest Ownership Act, which was proposed by the Uniform Law Commission. (Chapter 116 of NRS) Existing law also provides that certain civil actions relating to residential property within a common-interest community cannot be commenced in any court in this State unless the action has been submitted to mediation or, if the parties agree, to a program established by the Real Estate Division of the Department of Business and Industry under which a person such as a referee or hearing officer renders decisions on certain claims. (NRS 38.310) This bill provides in skeleton form for the repeal of existing law governing common-interest communities, which in turn provides for the enforcement of matters relating to common-interest communities through private civil action.
