This bill amends existing New Mexico law to allow mobile home park owners to create nonconforming lots by transferring ownership of individual mobile home spaces. Specifically, it permits the creation of separately owned lots without adhering to the dimensional requirements typically mandated by underlying zoning districts, such as minimum lot size and building setbacks. Additionally, it exempts these transfers from the infrastructure improvements that would usually be required under subdivision regulations.
The bill also modifies the authority of county and municipal zoning authorities, allowing them to regulate various aspects of land use while ensuring that regulations remain uniform within each district. It introduces provisions for accommodating multigenerational housing by permitting up to two kitchens in single-family zoning districts. Furthermore, it clarifies that no regulations under the Manufactured Housing and Zoning Act can prevent the transfer of ownership of mobile home spaces to create these nonconforming lots.
