The proposed bill establishes the Office of Energy Information in New Mexico, which will be administratively attached to the Energy, Minerals and Natural Resources Department. This office is tasked with collecting and analyzing energy and emissions data from various energy-sector entities, which include those involved in the ownership, exploration, extraction, processing, and distribution of energy resources. The director of the office will be appointed by the governor and will have the authority to hire staff as needed. The office will also be responsible for making energy and emissions data publicly accessible while ensuring the protection of proprietary information. Additionally, it will produce an annual report starting January 1, 2027, detailing the competitive structure of the energy industry and other relevant analyses.

To support the establishment of the Office of Energy Information, the bill mandates the creation of an Energy Information Working Group by August 31, 2026. This group will consist of representatives from various state departments and will be responsible for identifying relevant energy and emissions data collected by executive agencies and proposing formats for reporting that data to the new office. The bill includes an appropriation of $3 million from the general fund for the office's operational costs in fiscal year 2027, with any unspent funds reverting to the general fund at the end of the fiscal year.
