This bill amends Section 66-3-835 of the New Mexico Motor Vehicle Code to allow recovery and repair vehicles to display flashing lights while engaged in the removal of disabled vehicles. Specifically, it removes the restriction that previously prohibited these vehicles from using red flashing lights, thereby permitting them to use flashing lights in any color, including red, while actively engaged in their recovery operations. However, the bill clarifies that this allowance does not extend to the use of flashing lights when the vehicles are traveling to or from the scene of a disabled vehicle or while towing.
Additionally, the bill maintains existing regulations regarding the use of flashing lights by other types of vehicles. Only fire department vehicles, law enforcement agency vehicles, ambulances, and school buses are permitted to display flashing red lights visible from the front. All other vehicles authorized to use flashing lights must utilize colors other than red. The provisions of this act are set to take effect on July 1, 2026.
