This joint resolution proposes an amendment to Article 4 of the New Mexico Constitution to establish a permanent Interim Administrative Rule Oversight Committee. The committee will consist of twelve legislative members, appointed by the majority and minority floor leaders of both the House of Representatives and the Senate. The committee will meet at least once a month during legislative interims and will have the authority to review proposed agency rules, make recommendations, and suggest changes to the authorizing statutes to clarify legislative intent.
Additionally, if the committee finds that an agency rule does not comply with the authorizing law, it can recommend that the legislature overturn the rule during a legislative session. The resolution stipulates that the amendment will be submitted to the public for approval or rejection in the next general election or any special election called for that purpose.
