The bill amends the Public School Code by introducing a new section that empowers the Secretary of Public Education to take action against local school board members who are willfully neglecting their duties. If the Secretary has reasonable grounds to believe that a member is failing to perform their required duties, they must provide written notice detailing the failures and mandating remedial action within a specified timeframe of no less than thirty days. This notice will also be shared with the local school board and superintendent.
If the member does not comply with the remedial action within the given time, the Secretary has the authority to suspend the member from their position until the necessary actions are taken. Upon suspension, the Secretary must notify the member of the grounds for suspension, the process for reinstatement, and the right to request a hearing to contest the suspension. The bill also allows the Secretary or their designee to assume the duties of the suspended member solely to break a deadlock in the approval of the school district's annual budget.
