This bill establishes a private right of action for residents or businesses within a county or municipality to compel local governments to enforce their ordinances. If a county or municipality fails to enforce an ordinance, affected parties, including the attorney general, can provide written notice to the governing body. The local government is then required to respond within fourteen days, either by enforcing the ordinance or explaining why it has not been enforced.

If the county or municipality still does not take action after the notice period, the resident, business, or attorney general may file a civil lawsuit in district court seeking injunctive relief to compel enforcement or repeal of the ordinance. The bill also allows for the awarding of reasonable attorney fees and costs to the prevailing party in such cases. The provisions of this act are set to take effect on July 1, 2026.
