The proposed bill aims to prohibit book banning in public libraries across New Mexico, establishing that libraries funded or operated by the state, counties, or municipalities cannot exclude or remove materials based on partisan or doctrinal disapproval, or the protected characteristics of the intended audience or creators. It mandates that these libraries create a written procedure for individuals to challenge materials deemed obscene or unlawful, while also ensuring that libraries cannot face funding reductions or retaliatory actions against staff for adhering to these provisions.
Additionally, the bill stipulates that any public library that violates the prohibition on book banning will be ineligible for state funding. Enforcement of these regulations will be the responsibility of the library division within the cultural affairs department. The provisions of this act are set to take effect on July 1, 2026.
