This joint resolution proposes an amendment to Article 4 of the New Mexico Constitution to establish a permanent Interim Administrative Rule Oversight Committee. The committee will consist of twelve members appointed by the majority and minority floor leaders of both the House of Representatives and the Senate. The committee will meet at least once a month during the interim between legislative sessions and will be responsible for reviewing proposed agency rules, making recommendations to the proposing executive agency, and suggesting changes to the authorizing statutes to clarify legislative intent.
Additionally, if the committee finds that an agency rule does not comply with the authorizing law, it can recommend that the legislature overturn the rule during a legislative session. This amendment aims to enhance legislative oversight of agency rules and ensure that they align with legislative intent. The proposed amendment will be submitted to the public for approval or rejection at the next general election or any special election prior to that date.
