The bill establishes a program within the New Mexico Department of Transportation to award advance purchase commitments for low-emissions cement, concrete, asphalt binder, or asphalt mixtures, with the aim of promoting innovation, reducing emissions, and creating market demand for these materials. By January 1, 2026, the department is required to implement this program, which will only award commitments if private entities provide detailed information about the materials, including environmental product declarations or life cycle assessments. The department will also confirm that the materials meet specific greenhouse gas emission thresholds and technical specifications.
In awarding these commitments, the department will prioritize submissions based on factors such as the reduction of greenhouse gas emissions during production, the suitability of the materials for their intended use, and the potential to enhance the availability of low-emissions materials in New Mexico. Additionally, the bill allows for contracts or materials purchased under this program to be assigned to local transportation authorities at the discretion of the secretary of transportation. The provisions of this act will take effect on July 1, 2025.
